Services: Professional Trustees
Management Guidance, LLP attorneys serve as professional management trustees to a variety of Taft-Hartley benefit funds with an emphasis on pension and health plans. A professional trustee accepts the same fiduciary duty that is required of all trustees, brings a level of experience and expertise to the trust that supports all trustees and fund professionals in fulfilling their responsibilities to the plan, and maintains regular communications with the appointing employers to ensure that they are well informed about the plan’s operations. As professional trustees, our attorneys have overseen complex matters such as implementation of alternative plan designs, disputes among trustees and plan professionals, and service as the sole trustee to orphaned and troubled funds under the oversight of the Pension Benefit Guaranty Corporation (PBGC). Our professional trustees are normally appointed on a long-term basis but may also serve in limited roles to assist the other trustees with special issues and deadlock resolution.
